POLICY AND PROCEDURES

VOLUNTEER LIABILITY WAIVERS

PURPOSE

This policy outlines the affiliate’s position regarding completion and retention of volunteer liability waivers. These waivers serve two related and very important functions. First, they provide legal protection to the affiliate in case of potential lawsuits. Equally as important, they help to educate the volunteer about the potential hazards of volunteering with the affiliate.

POLICY

1. All volunteers, including partner families working at a construction site, warehouse, ReStore or office complex, will complete a Waiver and Release of Liability Form as outlined in Appendix A for adults and Appendix B for minors prior to any volunteer work.

a. It is the policy of Habitat that children under the age of 16 are not allowed on a Habitat     work site while there is construction in progress. It is further the policy of Habitat that, while children between the ages of 16 and 18 may be allowed to participate in construction work, ultra-hazardous activity such as using power tools, excavation, demolition or working on rooftops is not permitted by anyone under the age of 18.

2. In addition to completing the Waiver and Release of Liability Form, all volunteers and partner families will sign in the site log book at each volunteer location. The sign-in sheet there will have abbreviated waiver language used which orients the volunteer to the hazardous nature of the work.

3. Waiver and Release of Liability forms will remain in effect for one year at which time a new form will be required.

4. Waiver and Release of Liability forms will be retained on file for at least one (1) year beyond the statute of limitations counting from the last day the volunteer works with Starke/Pulaski Habitat for Humanity, Inc.

(2 years per Ind. Code 34-11-2-4 (1998)
